Terms of Service
Last updated: [DATE]
Draft — pending legal review. Not yet in effect.
The service
GrainFlash rents sets of digital cameras for events. Booking a rental also means accepting our Rental Agreement, which covers the specific rules for the physical equipment — damage, loss, late returns, cancellation. These Terms cover the website and account side of things.
Eligibility
You must be at least 18 years old and able to form a binding contract to book a rental. Rentals ship within the United States only.
Accounts and access
Booking requires no account or password — your booking is tracked by your confirmation and the email you provide.
Your photo gallery is accessible via a unique link, optionally protected by a PIN you set. Keep that link and PIN private — anyone with the link can view, and with the PIN, manage your gallery.
Admin accounts are for GrainFlash staff only; unauthorized access attempts are a violation of these Terms and applicable law.
Payment
Prices are listed at grainflash.com/pricing and confirmed at checkout before you pay. Payment is processed by Stripe; sales tax is added where required by law. A card may be held on file per the Rental Agreement, to cover damage, loss, or late fees you've agreed to.
Acceptable use
Don't use the site to attempt to book rentals fraudulently or with stolen payment methods, interfere with the site's operation (automated scraping, bypassing rate limits or security controls), access another customer's gallery or booking without authorization, or use rented equipment for any unlawful purpose.
We may cancel a booking or restrict access to the site for violations of these Terms.
Intellectual property
The GrainFlash name, logo, and site design are owned by [BUSINESS LEGAL NAME]. Photos in your gallery are yours — we don't claim ownership, and we don't use your event photos for our own marketing without your separate, explicit permission.
Disclaimers and limitation of liability
The site and service are provided "as is." To the maximum extent permitted by law, GrainFlash is not liable for indirect, incidental, or consequential damages arising from use of the service; our total liability for any claim relating to a booking is limited to the amount you paid for that booking; and we are not responsible for delays caused by shipping carriers, events outside our control, or your own misuse of rented equipment (see the Rental Agreement for the specific fee schedule that applies instead of unlimited liability for damaged or lost equipment).
Nothing in these Terms limits liability where the law doesn't allow it — for example, for our own gross negligence or willful misconduct.
Changes to these Terms
We may update these Terms as the business grows. We'll update the "Last updated" date and, for material changes, note it on the site. Continuing to use the service after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of [STATE], without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in [STATE], and you consent to that venue.
